Introduction

Welcome to Elevate Medical Center (“Elevate,” “we,” “us,” or “our”). Elevate Medical Center is a healthcare provider operating in Seattle, Washington. We provide medical evaluation, treatment, and related healthcare services administered by appropriately licensed healthcare professionals in accordance with Washington law.

These Terms and Conditions (“Terms”) govern your access to and use of:

  • Our medical services

  • Our website

  • Communications with our office

By scheduling an appointment, receiving services, or using our website, you agree to these Terms. If you do not agree, you should not use our services or website.

These Terms do not replace or modify any rights you have under Washington or federal healthcare laws.

1. Medical Services

1.1 Medical Evaluation and Eligibility

All treatment services begin with a medical consultation conducted by a licensed healthcare provider authorized to practice in Washington State.

You must be at least 18 years of age to receive services unless otherwise permitted under Washington law with appropriate parental or guardian consent.

By booking an appointment, you represent that:

  • The information you provide is accurate and complete

  • You will update us regarding any changes in your health or medications

  • You understand that treatment decisions are based on the information you provide

You will be required to complete:

  • A medical history questionnaire

  • Required HIPAA acknowledgments

  • An informed consent form specific to your procedure

Under Washington law (RCW 18.71), only licensed providers may diagnose or treat medical conditions. Our providers have sole professional discretion to determine whether a requested treatment is medically appropriate. We reserve the right to decline or postpone treatment when clinically indicated or legally required.

1.2 Appointment Scheduling

Appointments may be scheduled:

  • By phone

  • By email

A deposit may be required at the time of booking. Deposit terms will be disclosed at scheduling.

You may be required to:

  • Complete intake forms prior to your appointment

  • Provide valid identification

  • Arrive at least 10 minutes prior to your appointment time

Failure to complete required forms may result in rescheduling.

1.3 Cancellations and Rescheduling

If you need to cancel or reschedule, please provide at least 48 hours’ notice.

If less than 48 hours’ notice is provided, your deposit may be forfeited unless:

  • There is a documented medical emergency

  • We determine in our discretion that waiver is appropriate

Washington law requires that cancellation policies be clearly disclosed; by booking, you acknowledge acceptance of the disclosed policy.

Late arrivals may result in shortened services or rescheduling.

1.4 Payment and Pricing

Pricing is subject to change and will be disclosed before services are rendered.

Payment is due at the time of service unless other arrangements are made in writing.

We accept major credit and debit cards and other approved payment methods.

Completed medical services are generally non-refundable. However, nothing in this section limits rights you may have under Washington’s Consumer Protection Act (RCW 19.86) or other applicable laws.

2. Results and Medical Disclaimer

Medical and aesthetic outcomes vary by individual.

We do not guarantee:

  • Specific medical or cosmetic results

  • Duration of results

  • Satisfaction with aesthetic outcomes

Treatment outcomes depend on factors including:

  • Individual biology

  • Medical history

  • Lifestyle

  • Adherence to post-treatment instructions

Nothing on our website or in marketing materials constitutes a guarantee of results.

You acknowledge that:

  • Medicine is not an exact science

  • All procedures carry inherent variability

  • You have had the opportunity to ask questions prior to consenting

This section does not waive liability for negligence or misconduct to the extent prohibited by Washington law.

3. Risks and Informed Consent

All medical procedures involve risks.

Before treatment, you will receive and sign a procedure-specific informed consent form describing:

  • Alternatives

  • Potential complications

Under Washington law (RCW 7.70 – Medical Malpractice Act), informed consent is required before non-emergency medical treatment.

You are responsible for disclosing:

  • Medical conditions

  • Allergies

  • Pregnancy status

Failure to disclose relevant medical information may increase risk.

4. Limitation of Liability

To the extent permitted by Washington law:

Elevate Medical Center shall not be liable for indirect, incidental, or consequential damages arising from use of our website.

However:

Nothing in these Terms limits liability for:

  • Professional negligence

  • Medical malpractice

  • Violations of Washington statutory rights

  • Conduct that cannot legally be disclaimed

Any limitation of liability for medical services will be enforced only to the extent permitted under RCW 7.70 and related Washington law.

5. Indemnification

You agree to indemnify Elevate Medical Center for claims arising from:

  • False or misleading information you provide

  • Your violation of these Terms

  • Your unlawful use of the website

This provision does not apply to claims arising from our own negligence or statutory violations.

6. Website Use

6.1 Acceptable Use

You agree not to:

  • Violate any federal or Washington law

  • Attempt unauthorized access to our systems

  • Transmit malware

  • Disrupt website functionality

  • Use automated scraping tools without permission

We may suspend website access for violations.

6.2 Intellectual Property

9.2 Venue

  • Or the United States District Court for the Western District of Washington

9.3 Informal Resolution

Before initiating formal proceedings, you agree to contact us in good faith to attempt informal resolution.

We do not currently require arbitration.

9.4 Class Action Waiver

To the extent permitted under Washington law, disputes shall be resolved on an individual basis and not as part of a class action.

If any portion of this section is found unenforceable, the remainder shall remain in effect.

10. Miscellaneous

10.1 Entire Agreement

These Terms, together with our Privacy Policy and Notice of Privacy Practices, constitute the entire agreement regarding website use and services.

10.2 Severability

If any provision is unenforceable under Washington law, the remainder shall remain effective.

10.3 No Waiver

Failure to enforce any provision does not constitute waiver.

10.4 Assignment

We may assign these Terms in connection with lawful business transfers.

10.5 Force Majeure

We are not liable for delays caused by events beyond reasonable control, including public health emergencies or government orders.

11. Changes to Terms

We may update these Terms as required by law or operational needs.

Continued use of services after updates constitutes acceptance.
